General Terms and Conditions

for the visit of study programs and events of the M/O/T
The following terms are applicable to all legal transactions between the M/O/T School of Management, Organizational Development and Technology (hereafter: M/O/T) and its contractors. With regard to the individual study programs and other events, the rights and obligations of the contracting parties are hereby clarified by the content of any program or event information as well as any other communications from the M/O/T.

1. Training programs and events

1.1. Application Procedure
Applications must be submitted in writing and shall be examined according to the eligibility provisions of the relevant training program (see also the curricula of each program). Registration is considered binding for the entire course of studies. Applications will be considered in the order of their arrival. Master's degree programs have a limited number of places. The management of the M/O/T is charged with the duty and obligation, in addition to meeting the formal admission requirements, to examine the personal and professional competence of candidates. The M/O/T is not obligated to verify the truthfulness of statements made in the application or documents submitted.
 
The payment of the participation fee shall be made according to how it is specified in each program. If there is a cancellation, then paragraph 1.3 of the general terms and conditions is applicable.
 
If the number of applications should exceed the participant spots available or the educational or other appropriate balance of participants requires more spots than those offered, the M/O/T and/or the course directors reserve the right to make selections based on the qualifications of candidates.
 
By subscribing to a study program or an event, the participants agree to the automated processing of their data. Furthermore, they agree that with the granting of a university place, that their name, telephone number and e-mail data may be passed on for the administration of the course and to facilitate internal communication to fellow students, lecturers, persons responsible for the organization of the training organization, and any partners of M/O/T who are involved with the participants of the course. In principle, all personal information of the participants is treated in strict confidence and not passed on to third parties (with the exception of the above).

1.2. Program Changes
Courses and other events are planned in the longer term. Due to continuous quality checks, there may still be adjustments. A change of curriculum, content, event days, locations and deadlines, as well as of speakers, even if such changes occur at short notice, do not entitle the participant to rescind the contract or to reduce tuition fees, or to make any claims for damages.


1.3. Cancellation

Cancellation by Participants  
 
A withdrawal of registration (cancellation) can only be made in writing. The cancellation possibility varies depending on the course and the respective program. For all courses, however, the entire tuition fee is to be paid in the case of cancellation that occurs after the beginning of the course. The cancellation fee is waived, if a substitute participant is found and meets the eligibility criteria, and all fees have been paid in full. Before this time, the cancelling party is liable for the entire amount of the newly attending substitute participant.
For events, cancellation of registration may occur up to 30 days before the event without a participation fee being charged. If cancellation occurs at a later date, the entire fee will be charged. 

Cancellation by the M/O/T
The M/O/T reserves the right to cancel a course or a seminar, for example, if the necessary number of participants is not achieved or if a speaker becomes ill. For a cancellation up to eight days before the start of the course/seminar, the participants may make no claim on property or other compensation. If the cancellation occurs within eight days before the beginning of said course/seminar, the M/O/T – to the exclusion of all other claims – will bear the verifiable costs incurred by students/participants for travel and accommodation. In the case of force majeure, such as for example, illness of a speaker, there will be no compensation. 

 
1.4. Exclusion from Participation
The M/O/T retains the right to exclude course participants and seminar participants from further participation for significant reasons (e.g. late payment in spite of a warning and a grace period of 14 days).


1.5. Liability for Personal Items
The M/O/T assumes no liability in the event of theft, loss or damage to property brought to the events.


1.6. Other
Changes of name, address and invoice address of the participant must be made in writing to the M/O/T. If no written notification of changes are made, all postal correspondence will be considered received by the participant if said correspondence has been sent to the last known address or billing address. For example, the participants are obligated to participate in information surveys in connection with the accreditation of a study program.

1.7. Payments and Statements
With the payment of the final invoice (final payment agreed and thus cover all the overdue tuition fee) all claims are paid. Additional claims can then no longer be asserted.

Participants will receive a certificate of attendance or testimony of their documents if they attended at least 75% of the seminars out of their university course and have paid the participation fee in full. The documents can not be issued on the graduation ceremony, provided that payments still are open.

2. In-house programs and other services

2.1. The M/O/T agrees to treat all matters made known through the performance of the contract – regardless of what type – in confidence and to not share such information with third parties. This obligation of confidentiality extends to all parties involved in the project.

2.2. The travel and subsistence costs charged (if the consultation takes place outside of Vienna and Klagenfurt, starting with and including the residence of the consultant/trainer) are calculated using:

  • € 0.42 per kilometer by passenger cars, €0.05 per kilometer for each passenger
  • other travel expenses (taxi, train first class, business class flight, bus, car, etc.)
  • accommodation costs in the current official rate, where official rates are exceeded, according to the list included.

2.3. Invoices are due in full upon receipt and are to be promptly paid.

2.4. For cancellations of orders already scheduled, the following conditions apply:
  • Cancellation 12 to 8 weeks before the agreed start of work, cancellation rate is 50% of the order.
  • Cancellation between 8 and 4 weeks before the agreed start of work, cancellation rate is then 70% of the order.
  • Cancellation within 4 weeks before the agreed start of work, cancellation rate is then 90% of the order.

This scheme is applicable to the activities defined and agreed upon in the course offerings as well as to those activities whose dates are already agreed upon in an option agreement between the client and M/O/T.
 
Schedule changes can be implemented by joint agreement.


2.5. All materials of the M/O/T provided or supplied in the context of training and consultation processes shall be given an M/O/T logo and therefore subject to copyright. The clients are free to completely use and adapt these documents within the organization. Any further use or disclosure to third parties (with or without naming the source) is only possible with the express written consent of M/O/T.

2.6. Agreements differing from our terms and conditions are binding for the M/O/T only if said agreements are expressed in written form.

3.  Jurisdiction

For all disputes arising from completed contracts between M/O/T and its contractors, the exclusive jurisdiction shall be that of the city of Klagenfurt.

 

4. Data security

This website uses Universal Analytics (and Google Remarketing.), (These are) a web analytics service(s) provided by Google, Inc. (“Google”). The information generated by the cookie about your use of the website will be transmitted to and stored by Google, on servers in the United States.

In case of IP Anonymization, as is used on this website, your IP address will be truncated within the area of Member States of the European Union or other parties to the Agreement on the European Economic Area. A clear association of the IP address will therefore no longer be possible. Only in exceptional cases the whole IP address will be first transferred to a Google server in the USA and truncated there. The IP Anonymization is active on this website.

Google will use this information on behalf of the operator of this website for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing them other services relating to website activity and internet usage.
The IP address that your Browser conveys within the scope of Universal Analytics will not be associated with any other data held by Google.
